California and Massachusetts to sue Trump administration over $100K H-1B visa fee

California and Massachusetts are preparing to file a lawsuit against the Trump administration concerning the new $100,000 H-1B visa application fee. The states contend that this measure places an unlawful burden on employers and was implemented without adhering to necessary federal rulemaking procedures. This legal action is the first state-led challenge to the fee, following earlier lawsuits filed by the U.S. Chamber of Commerce and a coalition of labor unions and staffing firms. The H-1B visa program permits U.S. employers to hire specialized foreign workers, a system Trump sought to overhaul in September, alleging it was exploited against American workers.
