U.S. CFTC's Pham Moves for Do-Over on 'Actual Delivery' Guidance on Crypto

U.S. Commodity Futures Trading Commission (CFTC) Acting Chairman Caroline Pham has initiated a move to withdraw the 2020 guidance concerning the "actual delivery" of crypto commodities. Pham stated that eliminating this outdated and overly complex guidance, which she suggested might hinder innovation, aligns with the administration's goals. The original guidance sought to define "actual delivery" under the Commodity Exchange Act. The CFTC noted the withdrawal was necessary to reevaluate the guidance in light of five years of developments in the spot market for virtual currencies. This action is one of several crypto policy moves Pham has driven recently, even as President Trump's nominee, Mike Selig, nears a potential confirmation.
